Supreme Court sets BBI Hearing Dates in January

Tuesday, November 9, 2021 –Supreme Court Chief Justice Martha Koome has set a hearing date for the Building Bridges Initiative BBI appeal which had flopped in earlier stages.

The case will be heard for a total of three consecutive days from Tuesday January 18 to Thursday January 20, 2022.

In that manner, the Court grouped three petitions of Attorney General vs David Ndii, 73 others, the Independent Electoral and Boundaries Commission IEBC vs David Ndii, 81 others and Lawyer Omokes vs Uhuru Kenyatta and 83 others.

“Petition number 12 of AG vs David Ndii and 73 others will serve as lead files in the proceeding.

“Petitioners in the three respective petitions will be the appellants while the rest will be respondents,” Koome delivered.

The appellants were also directed to file and serve their written submissions and the list of authorities within the next 10 days. On the side of respondents, they will have to do the same in 10 days period after receiving summon papers.

“All submissions should not exceed 15 pages,” she added but adjourned the court to allow the Judges to deliberate on further requests from lawyers.

The AG asked the court to allow them serve and submit files within 15 days and not 10 days as was being proposed; and took the opportunity to urge the court to also allow them maximum number of pages so that the case can have enough ground to proceed.

BBI was first rendered illegal by the High Court before the Court of Appeal upheld the same verdict what triggered the Attorney General to walk back into the final court seeking further clarification on some issues.
