Waluke, on his part, was given a sh 10 million cash bail while Wakhungu was freed on sh 20 million bail.

“I’m persuaded that applicants (Waluke and Wakhungu) have an arguable appeal,” justice Onyiego stated during the ruling.

The two convicts were jailed early this year on ground that they were involved in fraudulent activities at the Kenya Cereals and Produce Board NCPB where they allegedly received a whopping sh 300 million in 2004 for questionable tenders.

They were the first persons in the history of the country to have been jailed for 67 years.

During the today ruling, they were asked by Justice John Onyiengo to be reporting to the High Court Deputy Registrar only once a month.

The court further warned them not to leave the country without valid documented permission from Courts.
