Tuesday, February 8, 2022 –Chief Justice emeritus Willy Mutunga has faulted Amani National Congress ANC Party leader Musalia Mudavadi for asking ODM Party leader Raila Odinga to resign from active politics.

Reacting to Mudavadi’s latest remarks made in their Kenya Kwanza rally in Busia County, Mutunga wondered which clause was Mudavadi basing upon to ask Raila to resign from politics.

The ex-CJ explained that there is no law in the country that could bar Odinga from running for the next time for the top seat as is being pressured by some Kenya Kwanza coalition principals.

“A very unconstitutional request to make. Suppose someone asked you retire from politics? Which article of the Constitution are you relying on?” the former chief justice questioned.

While in their Busia County tours, the former vice president stated that they were tired of supporting the former prime minister and challenged him to pave way for new leaders.

“Tumechoka, tunamwambia Raila aondoe jam watu wengine waende mbele,” the Kenya Kwanza alliance principal stated which loosely translates to, “We are tired of Raila’s jam and he should pave way for us”.

However, the former Chief Justice Mr. Mutunga quickly reacted to the calls from Mudavadi saying the sentiments were baseless and unconstitutional.

He added that to ask someone to retire from politics was going against the law and cannot be argued successfully in any court of law.
