Monday, August 15, 2022 –The Judiciary has issued a clear procedure required in filing presidential election petition over the just concluded election exercise.
This is after the Independent Electoral and Boundaries Commission IEBC chaired by Wafula Chebukati today Monday August 15 cleared William Ruto as the duly elected president-elect who now has to be sworn into office as President Uhuru Kenyatta plans to leave office.
In a Notice dated Monday August 15, advocates, litigants and members of the general public have been advised to file their petitions at the Supreme Court sub registry located at Forodha House adjacent to Milimani Law Courts along Upper Hill Close Road.
Any unsatisfied party has to, therefore, file or submit their papers 14 hours before the outlined deadline of Tuesday August 23.
“Take further notice that, under Rule 7(3) of the Supreme Court (Presidential Election Petition) Rules, 2017, where the petition is filed on the last available day of filing, it shall be filed before 1400hrs of that day,” the notice it read in part.
This 7-day timeline in fully catered for under the 2010 promulgated Constitution and Supreme Courts Presidential Election Petition guiidelines published in 2017.
In the IEBC declaration made today by Wafula Chebukati, the President-elect William Ruto beat Raila Odinga with slightly over 200,000 votes.
Dr. Ruto, according to IEBC, received 50.49 percent of the votes, while Odinga received 48.85 percent.
