Tuesday, August 30, 2022 –Justice Philomena Mwilu has asked the two warring factions of the Independent Electoral and Boundaries Commission IEBC to not expect the court to choose which lawyer represents IEBC.
Responding to an open clash that was witnessed on the floor of the court when the two sides each came with their lawyer, Mwilu interjected quickly and asked them to choose for themselves the lawyer to represent the electoral agency IEBC.
This is after Lawyer Paul Muite for Cherera and Githu Muigai for Wafula Chebukati appeared to share a single client (IEBC).
But Judge Mwilu said the court will not be dragged into their internal mess and that the dispute standing in-between them can be sorted outside the Supreme Court walls.
“This court cannot deal with the issue or any dispute as to the legal representation of the IEBC. It is not the business of the court to determine who represents the IEBC.
“That is an internal issue that must be resolved by the IEBC internally,” DCJ Mwilu added
Speaking on Tuesday during the second session of the 2022 presidential election petition pretrial conference held in Milimani Law Courts, Mwilu said the court was too busy to listen to managerial sideshows bedeviling the electoral agency.
As of now, IEBC side of Wafula Chebukati is represented by Senior Counsel also former Attorney general Githu Muigai as the splinter faction of Juliana Cherera has hired the services of Senior Counsel, Paul Muite.
