Thursday, February 2, 2023 –Mr. Dennis Itumbi has won a whopping sh 630,000 court award over unfair dismissal from public office by the State.

In a court case he had filed at the Milimani Labour Court Nairobi after the Statehouse fired him as their digital strategist, Presiding Judge Jacob Gakeri found out that the previous regime did not comply with Employment Laws while firing the blogger.

Mr. Dennis Itumbi

The judge argued through his ruling that the digital media strategist required to be served with a warning or disciplinary letter first before any action could be taken.

The government, therefore, failed to guarantee fairness in the entire process that saw Itumbi go back to the streets.

“The respondents may have had a valid and fair reason to terminate the petitioner’s employment but did not comply with the requirements of the provisions of the Employment Act, 2007, to guarantee procedural fairness in the process,” The Standard quoted Justice Gikeri.

The Employment Act 2007 highlights the right procedure to be observed when dismissing an employee. This requires an early notice; or put up with compensating the affected party as per the notice.

Former President Uhuru Kenyatta

Itumbi had told the court that he was rendered jobless immediately the then president Uhuru Kenyatta started reorganizing his government. His office would be permanently abolished in that process.

The strategist is a close ally of President William Ruto.
