Blow to Ruto as High Court Halts CASs Assumption of Office

Friday, March 24, 2023 –High Court sitting in Nairobi has ordered all newly-appointed Chief Administrative Secretaries CASs not to assume office even after their swearing-in that took place yesterday Thursday March 23.

The High Court on Friday March 24 issued conservatory orders against the new State officials appointed by President William Ruto.

Justice Hedwig Ongudi made the ruling following a petition filed by both the Law Society of Kenya LSK and Katiba Institute to challenge the legality of the positions.

“Having read through the annexures, I am satisfied that interim conservatory orders are necessary. I, therefore, grant Prayer No 2 of the Notice of Motion in the interim,” the Judge read the ruling.

Consequently, the 50 CASs were barred from performing their office duties or enjoying any privileges of their positions, including drawing salaries, until the case is completed.

The new ruling was issued just a day after President William Ruto attended a colourful swearing-in ceremony held at the Statehouse Nairobi.

“I expect that each one of you will serve with honour and dignity,” Ruto told the new CASs at State House after overseeing the swearing-in ceremony announced to start at 7.30am. “I am looking forward to you bringing in the experience you have acquired elsewhere in serving the people of Kenya to serve in your new responsibilities.” Ruto urged them on Thursday March 23 noon.

This swearing-in took place despite the National Assembly Speaker, Moses Wetang’ula, taking back the list to the head of State. He argued that, constitutionally, neither him nor MPs have mandate to vet the candidates.
