Nairobi man charged for ‘defiling’ his pregnant wife

A Kibera Law Court has received a case in which an expectant wife has implicated his husband in a ‘defilement’ case.

On Wednesday December 3^rd, Principal Magistrate Charles Mwaniki charged the suspect for committing unnatural act of anal sex on his own wife contrary to Section 162(a) of the Penal Code.

He was accused of committing the offense on diverse dates between August 2020 and November 20202 in Kangemi Area.

The court also subjected him to extra charges of committing an indecent act with an adult without his consent.

The victim reported to the police that she has been living in peace with the man for four years until recently when he started changing and acting weirdly.

“We have been living a happy marriage life until August when he started behaving abnormally and in August this year he started forcing me to have anal sex with him,” read part of her police statement.

And when she tried to explain that she couldn’t do what the man wanted(anal sex), he forced himself into her what led to painful bleeding and damage.

“I told him that I was not comfortable and when I asked him why he was doing that to me he told me that he can do anything with me because I was his wife.

“I went to the hospital and I was treated but again I had developed sitting problems as a result,” she added.

She would later rush to hospital for treatment which saw her go through a surgery before she reported the matter to the police who came to arrest the suspect.

The suspect would then tell the court that he did not know the person who was calling herself his wife.

He questioned the names on the charge sheet saying he was not aware of such a person and therefore this was a strange matter in totality.

He was released on sh 400,000 bond and a surety of similar amount as hsi case was set for hearing on December 14^th.
