Thursday, June 22, 2023 –Lawyer Miguna Miguna has continued faulting the Kenyan legal System over the manner in which it handles criminal cases.
Reacting on today Thursday June 22 news that Felix Orinda aka Dj Evolve did not see MP Babu Owino with a gun, Miguna noted that it was out of order for the courts to want to rely on a bedridden victim to clear the name of the accused who, in this case, is Babu Owino.
Miguna released a long statement arguing how CCTV footage clearly captured the scene where the shooting occurred.
The lawyer added that, in the footage, Babu was seen holding a gun and pulling a trigger at the DJ and that this cannot be challenged in any court of law.
“Babu Owino shot DJ Evolve twice in the neck. DJ Evolve is crippled from the neck down and is now a complete vegetable.
“Everyone saw the video with Babu Owino holding the pistol and shooting DJ Evolve. The bullets that crippled DJ Evolve ejected from Babu’s pistol. It doesn’t require validation by the victim. That’s why we have ballistic forensic experts to connect criminal Babu to the gun and the bullets that were found lodged in DJ Evolve’s body,” Miguna explained.
The Canadian-based lawyer added that this is not a case that requires DJ Evolve to testify on whether he saw what happened or not.
Miguna added that the accused who is MP Babu, in a just system, would be convicted even if DJ Evolve was dead or incapable of speaking or comprehending what is going on.
“But Kenya’s legal system is broken and rife with ineptness and corruption. DJ Evolve should have been under protection by then,” he noted.
He faulted Kenya’s courts for not restraining Babu Owino from accessing the victim since this case is about the State against Babu Owino and not the victim.
“As it is right now, DJ Evolve is being victimised twice – with the direct supervision of the Courts!” Miguna commented further.
While testifying his defense in court, Babu owino told the court last week that he had already used a staggering sh 58.6 million to take care of Evolve’s health.
