Wednesday, June 30, 2021 -Renowned city and Senior Counsel Ahamednasir Abdullahi has dissected what law says about killing or murder.
Making the interpretation on Churchill live show, the Grand Mullah observed that with Kenyan courts, murder only happens when its predetermined. What therefore this means is one can only be charged and detained if he planned or had a motive to kill; something else is reduced to manslaughter and can lead to acquaintance.
For instance, the renowned lawyer explained that when someone finds a man with his wife or the vise versa and then attacks them, that is not murder since he was provoked to act. “The law allows you to kill.”
He also added another example saying when people fight in a bar – a bar brawl – and one of them accidentally kills the other, this is pure manslaughter because it was accidental. Just the same way one person has died so could the other.
He went ahead to confess that he has represented such cases so many of them and won. Abdullahi further argued that in a system where there is no corruption, a lawyer could easily tell when he or she is going to win a case.
And just a day after he said that, a Kiambu Court released a Mr. Karanja after he killed his cousin whom he found flirting with wife.
Justice Mary Kasanga said that the suspect – Mr. Karanja – acted in provocation and he never intended to kill.
