Friday, October 27, 2023 –Embakasi East Member of Parliament MP Babu Owino has claimed to have acquired true authentic documents of the contested Njiru land which the courts, days ago, ordered to be handed back to billionaire Gerishom Kirima.
The Environment and Lands Court sitting in Nairobi had recently handed over the 2,200 acres in Njiru, Embakasi East Constituency, to the family of the late billionaire Kirima in a case that had spanned for about nine years.
The court, during the ruling that had taken ages, gave 300 residents upto December 31 this year 2023 to leave the land or face demolitions and forceful eviction.
But MP Owino now says he had managed to retrieve important documentation in that respect that proves the late Kirima is not the true owner neither is the family as the court had suggested through the ruling.
Speaking to members of the press on Thursday October 27 in Nairobi, Owino announced that he had since established that the said parcel of land belongs to a foreigner from Itay.
In his address which had been attended by local leadership and residents, the second term lawmaker, while promising to put hi feet firm on the ground in defense of the occupants, stated that the parcel belongs to one late Dominica Demasi, who purchased the land from Suklal Madorum.
“The said land in question with an original LR number 5908/8/1, 5908/5/3 that this said parcel of land does not belong to Kirima nor does it belong to Kirima’s family. I’ve gone further as an MP, used my resources, done my investigations and I’m here with the relevant documents showing the original owner of the said parcel of land. We’ve gone further to bring this person all the way from Italy. As we speak, he is in Kenya and we will go to court,” Owino remarked.
The land has since been passed to the heir and now administrator Mr. Demasi’s son by the name of Bernardo Vincenso Demasi, and who has since been flown back to Kenya, to help unravel the property puzzle.
MP Owino went on to breakdown how the land morphed from one person to another revealing that it was bought by the Italian tycoon in 1966 three years after Kenya had attained its independence.
“Proof of ownership of land is by having a title deed before a competent court of law. The document I have here is one drawn in 1966, an indenture (which was been issued by the government at the time). The document shows that the land was sold to Dominico Demasi and he bought it from Mr. Suklal Madorum”.
He, therefore, asked the Kirima family to be ready to provide all the necessary documentations and transaction receipts of the parcel before negotiations between parties can commence.
He said the lives of the 300 dwellers on the land cannot be put at risk just because of one person who is struggling to own the land which is not his.
He wants the Kirima’s to produce to the court a copy of the Identification Card of the person who sold the land to the family, passport-size photos, rent clearance certificates, rates clearance certificates, transfer forms as well and proof of payment as per property laws in Kenya.
