Wednesday, November 29, 2023 –Investigations into the conduct of Mumias East Member of Parliament MP Peter Salasya have commenced with Chief Justice Martha Koome issuing a directive on the matter.
On Wednesday November 29, the Judicial Service Commission JSC condemned the Mumias East MP, accusing him of undermining the rule of law.
“The Commission has deployed its team to the ground to conduct further investigations and engage the agencies handling the matter with a view of taking appropriate action in line with its mandate,” JSC partly noted in their statement.
The JSC added that all judges are guided by independence and it was wrong for any aggrieved party to take that war on the streets instead of doing this through the rightful legal channel.
It added that Salasya who was a respondent in the Kakamega matter ought to have filed a counter-suit on the matter so that, if irregularities were discovered, those culpable shoud be punished too.
“The Commission wishes to reiterate that the decisional independence of a Judge or judicial officers must be safeguarded at all times, and when litigants are aggrieved by the decision of the court, they may seek redress through the appellate process.”
The judges and lawyers body assured JSC added that it will not just sit quite as members of the public aim unfair attacks on them.
Equally, the Law Society of Kenya LSK led by President Eric Theuri also asked the Directorate of Criminal Investigations DCI to investigate Salasya and, if possible, bring him to book.
In its statement signed by the leaders, LSK on November 28, argued that the best option against Salasya is to be arrested so that he can be forced to substantiate his wiled claims on the Kakamega judge.
“LSk urges the DCI to conduct a thorough, speedy, and impartial investigation to determine the facts surrounding the alleged threats.
“Judicial officers must be able to carry out their functions without fear of intimidation or threats while adhering strictly to the law,” read part of a statement by LSK.
MP Salasya who was ordered by the Kakamega court to repay a sum of sh 500,00 to a complainant, Robert Lutta, was alleged to have threatened to kill the presiding judge Gladys Kiama.
He also took to his socials claiming that the judge together with some lawyers had met several times in a local hotel planning on how to get money from him.
At some point in the clip, he asked the complainant to visit him in his offices in Mumias East to be paid all the money plus any interest accrued if need be.
