Court Compels Betika to Compensate ex-Employee sh 12.5M

Monday, February 6, 2023 –A court sitting in Nairobi has awarded former Betika employee a whopping sh 12.5 million in compensation.

The court under Employment and Labour justice Jacob Gakeri, awarded the ex-Betika technology boss, Fred Gitonga Njangi, his full dues.

The judge declined to grant Shop & Deliver Ltd trading as Betika their prayers of withholding two-thirds of Gitonga’s terminal dues after his dismissal.

“I find that withholding of Gitonga’s terminal dues by Betika was unjustifiable in law, and the avenue user to seek relief lacked the necessary anchorage, the application is unsustainable and is accordingly dismissed with costs,” the judge ruled.

Gitonga was fired last year following a multimillion fraud allegation where he was linked to a sh 11 million theft between January 13 and February 3 2022.

It was claimed that Betika conducted internal audit and investigations and realized that the tech officer had stolen their money and, immediately, commenced disciplinary action against him; before he was finally terminated and arrested last year in August.

The court, however, freed him upon paying a cash bail of sh 200,000.

The accused, Mr. Gitonga, was appointed the head of technology at the giant betting firm in December 2017 and confirmed six months later.

His monthly salary by the time of sacking was sh 1.9 million.
