Monday, November 22, 2021 –Lawyer Miguna Miguna continued to win big against the State after a Nairobi Court today Monday November 22 ordered government to process his travel document within 72 hours.
Delivering the ruling, Justice Hedwig Ong’undi asked government to expedite processing all the required travel documents through the Kenyan Embassy in Berlin, Germany or the High Commission where he has been held since last week when he was on his way to Kenya.
“Once in possession of the emergency travel documents and upon presentation of the same to the second respondent (Air France), the latter should allow the petitioner applicant to board the available flight to Kenya with immediate effect,” ruled Ong’undi.
Miguna was allowed by the court to use his Kenyan National Identity Card to get anything he wants as far as traveling back home in concerned.
“Upon landing in Kenya, the petitioner applicant to be allowed by the immigration officer to use his National Identity Card for purposes of identification,” Justice Ong’udi further ordered.
It’s after his arrival that he can then embark on applying for a new passport which must be issued within seven days as long as he has all that is required to fulfill the same.
Lawyer Miguna has taken to social media to thank his legal team for the victorious ruling promising to check into the Kenyan Embassy in Berlin for the documents.
“I’ll be at the Kenyan Embassy in Berlin in the next 2 hours. The struggle continues,” Miguna wrote.
He clarified that he will be presenting his National Identity Card to get the said emergency travel documents to Kenya.
Miguna’s lawyers had sued the State over the red alerts issued to Air France against their client who was scheduled to land in Kenya on November 16 via the Jomo Kenyatta International Airport JKIA.
