Thursday October 7, 2021 -Ex-KEMSA Board Chairman Kembi Gitura has lost ownership of a prime land in Nairobi in a long court battle.
Mr. Gitura who President Uhuru Kenyatta moved to Communication Authority CA, lost the battle on Wednesday October 7 after his attempts to overturn an earlier decision from the National Land Commission NLC which had revoked his title ownership of the Lang’ata land failed to yield.
In the court decision, it was established that the former Murang’a Senator was guilty and had strayed into public land.
His efforts to use court to reclaim the land which he acquired in 2008 from Ramii Rama & Co Advocates were futile even after he argued that he has authentic papers of the property including the Certificate of Lease.
Presiding Justice Loice Komingoi from the Environment and lands Court finally ruled against the State officer saying the parcel of land belongs to the public.
“It is not in dispute that the plan that guides development in the area shows no indications of private property in that location.
“Gitura does not claim that he was not aware of the public hearings, rather than the notice did not accord him the opportunity to know the allegations and/or the case he was required to answer. In my view this sounds far-fetched,” the Judge ruled.
Gitura was moved to Communication Authority CA at the height of the Kenya Medical Supplies Authority KEMSA multi-billion procurement saga; in a move that elicited public uproar.
