Monday, October 21, 2024 –Embattled Deputy President Rigathi Gachgau has questioned the three-judge bench constituted to hear and determine his ouster case.
In a letter he addressed to the Judiciary on dated October 20, Mr. Gachgua is seeking answers to know if Chief Justice Martha Koome participated in the formation of the the bench.
The letter addressed to the deputy registry at the High Court, has pointed out how the even number was reached at and if the law was followed in the whole exercise.
“The judges further considered and issued directions in Kerugoya High Court and issued similar directions for hearing on October 22, 2024.” the letter read in part as seen by sections of the media.
The questionable three judges are Justices Eric Ogola, Antony Mrima and Freda Mugambi who were constituted to oversee 6 cases and are also set to work on two more cases on Tuesday, October 22.
The judges are also accused in the letter of claiming there was no open date to hear the petitioners’ cases until October 29.
However, when the government went to the same bench with two new cases, the bench, somehow, managed to find two days earlier than the 29th.
Gachagua’s lawyer, led by awyer John Njomo, therefore, say this was a well-executed plan to “trample the rights of the petitioner”.
The impeached deputy president’s legal team is convinced Justice CJ Koome was not in the country to give a clear direction on the Judiciary’s next course of action on DP’s matter.
His lawyers are adamant that the impeached DP was denied a fair trial right from the National Assembly to the Senate and now the Judiciary.
The drama happening as plans to swear in the new deputy president, former Interior Cabinet Secretary Kithure Kindiki, are in high gear.
According to sources close to the House on the Hill, Prof. Kindiki will be sworn in on Tuesday October 22 before 10AM.
