Friday, October 18, 2024 –Lawyers representing Deputy President Rigathi Gachagua have acquired court orders stopping the swearing-in of new Deputy President, Kithure Kindiki.
Lawyer Njiiru Ndegwa, on Friday October 18, shared a screenshot of an active court order barring the swearing in of Kithure as a Gachagua replacement following DP’s impeachment that took place yesterday Thursday at the Senate.
“We hope CJ Martha Koome will respect this?” announced Njiiru while sharing the court order they secured, today.
But in a quick rejoinder, fellow lawyer Ahmednasir Abdullahi, asked the team to go over it as the orders had been overtaken by events.
He also pointed out that, the working relationship between the president and his deputy had worsened and could not longer work as a team.
“Hon. Rigathi Gachagua fought the good fight and lost it. He should stop this court circus and move on. The Office of Deputy President is a public office and both the President and the legislature don’t want him in the office. Gachagua should know that he can’t hold the office through court orders”.
This happening after the High Court in Nairobi on Friday issued conservatory orders stopping the appointment of Kithure Kindiki as the deputy president.
In his directive, Justice Chacha Mwita noted that the petition filed by Gachagua’s legal team raised monumental constitutional issues touching not only at the heart of a functioning Constitution but also its fundamental tenets of the rule of law and human rights.
