High Court Orders Immediate Release of Abductees

The High Court in Nairobi has allowed an application by the Law Society of Kenya and granted orders directing the National Police Service to, unconditionally, release Peter Muteti, Bernard Kavuli, Billy Mwangi, Gideon Kibet, Rony Kiplangat, and Steve Kavingo who are still held incommunicado by the State.

The NPS, in particular, was ordered to immediately facilitate the compliance with the Court’s directive both personally and in his capacity as IG.

The Court emphasised that failure to adhere to the order will invite penal sanctions for contempt of court.

“We are prepared to exhaustively prosecute such proceedings for contempt, should this order be disregarded by the IG and officers under his command,” LSK stated.

The court, equally, ordered the apex leaders of each of the constitutional bodies implicated in the abductions to personally appear at the full hearing of the application to answer to questions raised on the arbitrary infringement of rights sanctioned by themselves or by persons under their command.

The LSK reiterated its commitment to ensure these orders are served upon and adhered to by the relevant individuals
