Friday, November 12, 2021 –Lawyer Miguna Miguna’s scheduled return to the country has suffered another major blow after the High Court dismissed his application to lift the red alerts.
In the Friday November 12 ruling following a plea filed by Lawyer Nelson Havi, it was found out that there was no evidence to prove that Miguna had been stopped from coming back into the country.
Red alerts were initially raised during his earlier return to the country forcing the lawyer to go back to his Canada home. Until now he has never managed to travel to Kenya with government asking him to regularize his travel documents.
He was kicked out of the country based on a wild claim that he had renounced his Kenyan citizenship; a verdict he has unsuccessfully protested.
Ministry of Interior has since remained adamant that the outspoken lawyer must first regularize his documents before returning to Kenya.
However, today’s ruling by the High Court is subject o interpretation as it did not show clearly how Miguna can make his way into the country with the current active travel alerts.
“The only hindrance for Miguna’s return was the red alerts. We argued the case before Justice Edwin Okundi. If the ruling is in favour, there should be no reason as to why any airline should deny him permission to board,” Havi told the media adding that they had done whatever they were required to meet so that their learned colleague could make his way back home.
“We have done what is legally required to ensure Miguna comes back,” he added.
Yesterday, LSK Chairman Nelson Havi, former Chief Justice Willy Mutunga and United Democratic Alliance (UDA) Chairman, Johnson Muthama, ganged up against the State for blocking Miguna’s imminent return.
Havi and Mutunga had been scheduled to travel to Germany to meet Miguna on the way so that to accompany him home on November 16.
