ICC Chief Prosecutor Shares Azimio Letter for Fresh Case Against Ruto

Saturday, August 5, 2023 –Chief Prosecutor at the Hague-based International Criminal Court, Karim Khan, on Friday August 4, refused to make a comment on plans to investigate Kenya over the alleged acts of criminality in the protests.

Speaking on an interview on Tv47, on Friday, the chief prosecutor who was asked about any letter from Kenyan political players to start investigations, said he might not be able to talk on the matter due to its sensitivity.

He chose to remain tight lipped despite efforts by his host to find out whether there was any filing on his desk at the Hague.

“Let me recuse myself there,” Lawyer Khan responded.

The host tried to press him hard so that to squeeze out the information from him but he, instead, remained highly cautious and guarded by strict international legal principles.

The lawyer who represented both Ruto and Joshua Arap Sang at the ICC back in 2007, Khan, remained evasive throughout the Tv interview.

This is despite April 2023 reports that he (the prosecutor) had acknowledged receipt of a letter from Kenya seeking to prompt investigations into the conduct of State machinery on peaceful protesters.

Details emerged indicating that Raila’s lawyer Paul Mwangi had accused both President William Ruto and Inspector General of Police IG Japhet Koome of instigating police brutality on innocent picketers around Nairobi.

He also listed rampant destruction of private properties among them, the Northlands Estate Farm owned by the Kenyattas.

It also emerged that select lobby groups in the country had also petitioned the ICC prosecutor with claims that Ruto, IG Koome and Interior CS Prof Kithure Kindiki had committed crimes against humanity.

Interestingly, government side, also countered a similar accusation with request to Mr. Khan to commence investigations against Mr. Odinga.

The State accused the Azimio la Umoja boss of organizing destructive demonstrations despite Ruto having been cleared by the Supreme Court to become the fifth head of State.

Karim Khan arrived in the country on Thursday to receive an Honorary Degree from Mt. Kenya University.
