Lawyer Abdullahi Moves to East African Court of Justice

Friday, January 19, 2024 –Nairobi Lawyer Ahmednasir Abdullahi has gone to court to sue Chief Justice Martha Koome.

In a statement seen by this writer on Friday January 19, 2024, Abdullahi shared that he has already instructed his lawyers to take action against Judge Koome on the recent Supreme Court ban imposed on his law firm.

“I have instructed my lawyers to file a petition in the East African Court of Justice at Arusha to seek legal redress against KOOME’s judicial skulduggery and niggling shenanigans. I will not waste time in going to KOOME’s CORRUPT COURT,” wrote Abdullahi.

The Koome-led court, banned the lawyer from practicing in the Apex Court and to make any appeal at the Court of Appeal; what angered the lawyer and his supporters who, in response, have moved to the East African Court.

The Supreme Court judges argued that Lawyer Abdullahi has been undermining the courts through smear campaigns he runs on both social and print media.

The lawyer has constantly accused the courts of abetting corruption and failing to administer justice to the victims as per the law.

He has also been on record accusing the Chief Justice of incompetence and inciting the executive to take action against the unnamed corrupt elements in the judiciary.

The Law Society of Kenya LSK, yesterday January 19, issued its stand on the Abdullahi matter saying the actions taken against him by the Supreme Court are unconstitutional.

“Every person has a constitutional right to counsel of his choice. The Court cannot violate a consumer’s rights by dictating who should appear before them.

“The Court has no legal right to bar an Advocate duly authorized by the Law Society to practice law. 3. The decision has no basis in law, is illegal, irregular & paints the Court as a purveyor of injustice,” stated LSK President Eric Theuri.

LSK added that the Court’s decision violates the principle of right to be heard. A basic element of any fair decision.  The decision sets a dangerous precedent where courts can bar anyone they dislike.

“The Law Society will not allow its statutory mandate to be encroached upon by the Court and will seek an immediate retraction & apology from the Supreme Court,” Theuri noted further.

This back and forth happening at the time the executive and the Judiciary are in an untidy supremacy battle over the claims of corruption in the corridors of justice.
