Sunday, September 11, 2022 –Lawyer James Orengo has described the recent Supreme Court judgment as a pedestrian judgment delivered to serve a political purpose.
Speaking in Siaya County on Sunday September 11 afternoon, the seasoned senior counsel said it was an embarrassment in the whole judicial system when the seven judges decided to speak like people who never went to any recognized law school.
The new Siaya County governor added that he has practiced law for so long and he is in a better position to tell when the judgment is skewed or not.
“I want to say this without fear of contradiction, the judgment that the Supreme Court judges rendered was not a judicial judgment. The person who wrote that judgment has done a great injustice to the rule of law,” James Orengo remarked.
The Raila’s long-serving lawyer said, under normal judicial practice, a judgment should never sound so disrespectful the way the Martha Koome judgment sounded on that particular day.
An angry Orengo said respecting the rule of law cannot mean he cannot point out judicial mistakes seen in the latest ruling.
He likened the court proceedings to a football match where the referee must not lean towards any team and when a winner is declared, a loser must be treated well and not as a lesser being.
The Odinga’s lawyer also noted that not even a mere chief can use such demeaning words when dealing with village cases.
On the other hand, his colleague Otiende Amollo pointed out that Raila did not lose the election but a powerful clique surrounding the president was the one which fought very hard to make sure he(Raila) is not announced both by IEBC’s Wafula Chebukati and the Supreme Court.
