Friday, June 16, 2023 –Lawyer Miguna Miguna has taken issue with the Kenyan criminal justice system saying it had failed to charge high-level crime in the country.
Citing the case of Felix Olinda aka Dj Evolve against Embakasi East Memmber of Parliament MP Babu Owino, the Canadian-based barrister argued that there can be no way the youthful lawmaker can be declared innocent in any serious court.
Dr. Miguna who was talking through his newly-launched YouTube channel that has garnered about 4000 subscribers, explained on Friday June 16 that, unlike former Migori Governor Okoth Obado, MP Babu Owino was shown on CCTV video shooting unarmed and helpless Dj.
He proposed a stiff life sentence for the ODM legislator saying, in this case, no mediation should happen and that Evolve’s parents should not be used to cover up the MP for their love of money.
Miguna, therefore, accused Babu Owino of taking advantage of the vulnerability of Evolve to walk scot free on the streets of Nairobi even after committing the crime in the open.
“Father or mother to Evolve are not victims to the crime and, therefore, have no complete or final say in this case,” Miguna added.
He urged the government prosecution agencies to handle this case in accordance to the existing evidence and which he pointed out that Owino should be prosecuted to the fullest of the law.
The lawyer warned that, allowing such open crimes and criminals to thrive in the society was a bad signal for the security of the nation.
On Thursday June 16, MP Babu Owino through his lawyers, claimed that he had spent a whopping sh 58.7 million in medical treatment of Felix Olinda popularly known as DJ Elvove who he is accused of having shot and injured at B Club in Nairobi’s Kilimani area.
The MP told Milimani Senior Principal Magistrate Bernard Ochoi that his commitment to support the DJ is based on their long-time friendship that started way back in 2015.
