Sunday, November 26, 2023 –Lawyer Miguna Miguna has come out to warn President William Ruto against implementation of the National Dialogue Committee NADCO report released today.
Commenting on the recommendations, he told Dr. Ruto that any plans to subject Kenyans on a referendum will be rejected by the majority of the population.
“Finally, if president calls a referendum on the proposals by the NDC on the foregoing, he will lose even if the conman joins him in the campaigns – that is, if the judiciary fails to be guided by binding precedence in the BBI decision. I’ll lead the NO campaign!” he argued.
Dr. Miguna said the report was wrong on the creation of the Prime Minister office as well as the opposition office.
The self-styled general said further that the current presidential system, lawfully, does not allow such offices and that this will turn out illegal in the levent someone goes to challenge it in court.
“You cannot have the office of the leader of official opposition in a pure presidential system of government. Under a pure presidential system, we have the majority leader from the majority party in parliament and minority leader from the second most populous party,” he noted.
Similarly, the lawyer said, unless there is a change in the Constitution and system of government through a Referendum so that to impose a hybrid system in Kenya, there is no way this nation can have the positions of president and prime minister at the top at the same time.
And on the current position held by Musalia Mudavadi, the firebrand lawyer said the position of prime cabinet secretary as currently constituted has nothing to show off.
“PCS is just a cabinet secretary with jingles and vuvuzela. That’s why I have no problem with it,” he noted.
The report was officially unveiled on Saturday November 25 by the two co-chairmen Kalonzo Musyoka and Majority leader Kimani Ichubng’wah,
“NADCO is proud to midwife to the people of the Republic of Kenya, the NADCO 2023 Report. which has been electronically submitted to the principals representing the Kenya Kwanza and Azimio La Umoja Leadership.
“It is our firm belief that the Report has addressed the issues that formed the basis of the talks and the recommendations therein will progressively heal our wounds, foster togetherness, promote national unity restore our national pride, and usher us to greater prosperity,” Kalonzo announced.
President William Ruto and opposition leader Raila Odinga formed the National Dialogue Committee NADCO, and which was later established through a parliamentary process.
