Friday, January 26, 2024 –Lawyer Miguna Miguna has taken issue with the Kenya Kwanza administration for the series of court orders issued against it, regularly.
The lawyer who practices in Canada, through his social media platform, in particulate, X Platform, said Ruto’s administration will continue losing cases in court unless they respect the rule of law.
He said lack of operating within the Constitution will suffer the Kenya Kwanza administration several setbacks.
“I have strongly and consistently advised the Kenya Kwanza Government and President William Ruto to STOP fighting, antagonizing and threatening the Judiciary. Instead, I have advised that the principles of good governance compel them to always act within the constraints imposed by the Constitution, the Rule of Law and Democracy. If they fail to do so, they will continue to suffer major setbacks in the courts,” said Miguna in a statement of Friday.
Today alone, Courts sitting in Nairobi quashed as unconstitutional two appeals by the Kenya Kwanza administration.
First, the Court of Appeal said the Housing levy as imposed by the administration was illegal and should not be implemented.
Secondly, the high court stopped the deployment of police officers in Haiti saying the move was rushed and ought to have been deliberated upon by the Parliament.
The court ruled the exercise as unconstitutional hence sending Ruto back to the drawing board over the international matter.
