Wednesday, November 17, 2021 –Firebrand Lawyer Miguna Miguna has filed a lawsuit against his US-based counterpart Makau Mutua for defamation.
Miguna filed the suit in a Canadian court seeking a sum of sh 1.6 billion in compensation for defamation in which Makau linked him to sexual assault accusations.
Prof. Makau tweeted about Miguna having sexually assaulted his female clients who had sought legal representation in his firm in Canada.
The distinguished legal scholar at SUNY Buffalo School of Law in New York, went on to claim that the alleged case against Miguna was almost being revived.
“I am finished with Miguna Miguna — but I am waiting for Toronto courts and the bar to deal with him for charges of rape and sexual coercion on vulnerable refugee and immigrant women — some from Kenya — who sought his legal help to gain residency and asylum in Canada. Stay tuned,” tweeted Mutua on November 15.

But quickly taking offence of the claims, Lawyer Miguna demanded from the professor an immediate apology through the same social media platform as well as retract the claims within the next 24 hours or risk an expensive lawsuit.
“Take Notice that legal action shall be commenced against you if you do not forthwith publish a retraction and apology regarding the false allegations you made on Twitter on November 14, 2021, at about 1.16p.m. about me,” said Miguna.

Makau was therefore required to find a lawyer in Ontario Canada to file his defense with regard to the suit having turned down calls to pull down the controversial post and apologize as had been demanded by Miguna.
“A legal proceeding has been commenced against you by the plaintiff. The claim made against you is set out…If you wish to defend this proceeding, you or an Ontario lawyer acting for you must prepare a statement of defence in Form 18A prescribed by the Rules of Civil Procedure, serve it on the plaintiff’s lawyer or, where the plaintiff does not have a lawyer, serve it on the plaintiff and file it,” partly read the suit papers.
Meanwhile, Miguna is still stuck in Germany where he had moved to on his way to Kenya before the Air France blocked his journey due to fresh red alert from the Kenyan authorities.
He was expected to land in Kenya on November 16 via the Jomo Kenyatta International Airport JKIA.
