Thursday, October 28, 2021 –Judges could soon go to an industrial strike in protest of the government’s culture of ignoring court orders.
Ex-Chief Justice Dr. Willy Mutunga has called upon all the judges to plan to strike so that to teach the executive a lesson on how things should be run in a law abiding country.
Dr. Mutunga, while expressing these views on Thursday October 28, noted that it was getting out of hands that this government more so led by the head of State could lead in dishonoring active court orders.
Kenyatta’s government has been at constant loggerheads with the Judiciary since ascending to power in 2013 and in 2017 he threatened to ‘revisit’.
“We shall revisit this thing. We clearly have a problem,” he said, referring to the judiciary .
The former CJ now wants the entire nation to rise up against the Jubilee administration so that they can start to comply with court decisions. This made one of the reason he wanted to bring back Miguna Miguna who is exiled in Canada.
He also asked the State to apologize to Dr. Miguna for the actions taken on him against the Constitution of Kenya.
Not only Mutunga, his successor David Maraga in 2019 also warned Uhuru Kenyatta against disobeying orders saying this was the worst culture any country can start.
However, these were all mere statements which yielded nothing as far as the relationship between the Executive and the Judiciary arms of governments are concerned.
Currently, there are six pending judges whom the court has asked Uhuru to appoint within just 14 days; a decision he has rushed to court to appeal.
