Friday, September 27, 2024 –New Police Inspector Douglas Kanja has started his spree of court contempt.
In a new petition filed by the Law Society of Kenya in Nairobi court today Friday, Kanja is accused of failing to show up in court despite summons delivered to him over a series of police excesses.
LSK lawyers accuse the police boss of overseeing the deployment of hooded officers who blocked peaceful protesters who were headed to present a petition to the Office of the President that should be accessible and public
LSK also argue in the petition that there is an active court order barring policemen from covering their faces whenever deployed to deal with civilians.
The police are also instructed, by law, to display their service numbers so that to remain identifiable all the times, especially, when dealing with peaceful protesters,
On the same note, new orders by the court instructed the police boss to make sure that any plain clothe officer deployed in public must uncover their faces.
“The respondents have since violated these orders and continued to deploy unidentifiable, masked police officers and uniformed police officers with hidden concealed service numbers in disregard of the pronouncement of this Honourable Court specifically,” LSK wrote in the petition.
LSK, therefore, claim the new Police boss has violated Articles 10, 73, 159 and 244 of the Constitution.
In that regard, the lawyers body wants the court to move with speed and convict Mr. Kanja for the mentioned charges of going against the law.
“That the above sentence be and is hereby suspended if, within 14 days of the order, the police IG gives a written undertaking to comply with the order and guarantee a non-repetition of their disobedience of the court’s order of August 14 2024,” stated the Law Society.
A day ago, High Court sitting in Nairobi required the IG to show up over the missing Wajir County MCA Yussuf Ahmed.
The police IG alongside Director of Public Prosecution Renson Ingonga were directed to produce the politician.
