Friday, July 28, 2023 –Busia Senator Okiya Omtatah has maintained that he will not stop pushing for the suspension of the Controversial Finance Act 2023.
Reacting shortly after the Appellate Court, today Friday July 28, lifted the suspension of the Act, Omtatah said that he will have to put to task the proponents of the Act when the matter reaches its full hearing later this month.
He stated that all the questionable areas in the Act will have to be discussed and, if possible, quashed off.
“We will not give up until the Finance Act 2023 is repealed or entirely quashed by the Court because it contains provisions which are parallel to the Constitution,” Okiya stated.
Asked about any particular Clause, Omtatah noted that the Housing Levy as stipulated in the Act violets the right to equality as well as property.
“No one should be forced to contribute money in a manner that suggests that the citizens are fundraising for the government. We will oppose it before the Court of Appeal,” Okiya noted.
Falling short of calling out the Court of Appeal judges who gave the Act the greenlight, Omtatah said High Court judges were right in their earlier decisions; unlike their counterparts at the Court of Appeal.
The politician brushed off claims by the government that the suspension had affected revenue collection for government.
The senator said, should the Act go into full implementation without being challenged some parts, Kenyans will feel the brunt of its flaws.
On Friday, July 28, the Court of Appeal lifted the orders barring implementation of the Act pending hearing and determination of the appeal.
The Court argued that any continued suspension has a negative financial impact to the nation as a whole.
