Senate Decides on how to Handle Gachagua

Wednesday, October 9, 2024 –The Senate has made a decision to hear Deputy President Rigathi Gachagua impeachment through the plenary way.

Speaker Amason Kingi announced that this exercise will be taking place in two days – Wednesday and Thursday -next week.

Gachagua has, however ,been advised to file his response by Monday next week before the Senate picks up the matter officially.

The decision to hear this case via the plenary was reached at after Nairobi Senator Edwin Sifuna turned down a proposal from his Kericho County counterpart Aaron Cheruiyot to second the motion that required 11 Committee members to read, analyse and determine which way to go.

“This is a matter that is very unique and has elicited public attention. Therefore, given the mood of the house especially on the minority side, I respectfully decline to second that motion.” Sifuna told the Senate.

This saw Speaker Kingi then deliver the verdict asking the 47 senators to prepare to hear the matter next week in the plenary.

“You will note that the Senate Majority Leader has moved a motion, the motion has however, failed to get a seconder, Standing Order 70 of the Senate SOs states that the question on any motion shall not be proposed unless it shall has been seconded and any motion that is not seconded shall be deemed to have been withdrawn and shall not be moved again in the same session,” asserted Kingi.

DP Gachagua is facing an ouster motion that could see him finally impeached next week but, as he has indicated, he will be heading straight to the courts to save him.

His lawyers said they will explore all available legal avenues to retain their client in office despite the political pressure.
