Thursday, October 17, 2024 – Deputy Chief Justice Philomena Mwilu has today reacted on the ongoing impeachment of Deputy President Rigathi Gachagua.
Speaking on Citizen Tv on Thursday October 17, the DCJ said, it remains a Constitutional process and it is not anything unique handling the case on Mr. Gachagua.
“If it comes back to the court because it has been here in the lower courts, after the Senate, whatever is it that will happen there in the Senate, to us is case like the next case,” she commented.
The DCJ added that when the matter is finally on their desk at the Judiciary for determination, law will be strictly followed.
Judge Mwilu noted that they will handle the matter within the law and decide on its fate in accordance with the guidelines of the Kenyan Constitution.
“The matter will be handled by we who sit in the judiciary in the manner that the Constitution and laws authorises us to deal with it. We can’t go outside the law”.
Gachagua promised to take the matter to the Supreme Court where he believes justice will finally be served and saved from losing his government job.
He was voted out in Parliament with over 280 MPs; setting stage for a long titanic battle with senators and in court.
Elsewhere, the Directorate of Criminal Investigations (DCI) has recommended the withdrawal of the Sh 1.1 billion Finland and Canada Education Programme scandal case against Uasin Gishu Senator Jackson Mandago and two county officials.
This is after it emerged that the evidence brought to the court was not weighty to warrant the case to go on.
There was also insufficient witness presence as the complainant kept skipping the matter on several occasions.
