Tuesday, June 4, 2024 –Ian Njoroge’s lawyer has told the court that his client is being harassed by the police before being found guilty.
Today Tuesday’s sitting saw a lot of drama take place as Ian was discreetly masked by his parents; what the police quickly tried to stop by ordering him to remove the mask only for the vocal lawyer representing him to stamp his authority that this is a democratic right and that having a mask is not breaking the rules.
“The accused is in court and has lawyers. This is a court of law and you have no powers to harass the accused. It is a national obligation. Do not harass the accused person,” he noted.
The lawyer who appeared ready to save Ian from the jaws of the State also wondered how 21 police officers would be assigned to man the accused who is already in court.
“This person is only 19 years brought here by 21 police officers who escorted him. If they had time to sit down, they could have provided an affidavit. They should have drafted an affidavit. He is a victim of State indolence,” he noted.
He challenged the police and the prosecution to produce any affidavit in support of their allegations.
“A criminal proceeding of this nature is to be tendered by way of affidavit. That is as per the Evidence Act. Since he who averse must prove, the State has made wild allegations of crowds forming in police stations without any prove to that effect,” the lawyer argued for his client.
Njoroge, 19, was captured on the road attacking a traffic police officer with kicks and blows before taking off using a private car.
This criminal act has seen him become the new visitor of the State and has since been charged with robbery with violence, resisting arrest and causing grievous bodily harm to a police officer.
