Bobi Wine between a rock and hard place as Court dismisses his new evidence

Wednesday, February 10, 2021 – Uganda’s opposition leader Robert Kyagulanyi suffered his second setback after part of his petition was dismissed on grounds of merit.

Kyagulanyi – National Unity Platform NUP Party leader – who recently filed a law suit to challenge the election of President Yoweri Museveni into power for another stint is seeking to oust the incumbent through the Supreme Court despite swearing in ceremony having been conducted.

However, Uganda’s Supreme Court on Tuesday February 9 dismissed Bobi Wine’s application to amend the suit and include further grounds.

According to the Daily Monitor, when the courts session resumed at 4PM, Justice Stella Arach Amoko said Wine’s application was not suitable and that whatever fresh ground he wanted to include had been captured but advised them to do affidavits in that respect.

“Supreme court has dismissed an application by National Unity Platform (NUP) presidential candidate Robert Kyagulanyi alias @Bobiwine to amend his election petition challenging President Museveni`s victory,” the Daily Monitor reported.

According to the Monitor, other judges on the bench include Chief Justice Alfonce Owiny Dollo, Justice Rubby opiyo Aeri, Esther Kisaakye, Faith Mwondah, Paul Mugamba, Mike Chibita, Ezekiel Muhanguzi and Night Percy Tuhaise.

In the new papers which Wine had presented, he argued that Mr. Museveni was illegally nominated for the presidential race because he is the head of State, Commander in Chief and the Chairperson of the National Security Council.

Wine’s legal team claim that a person in that capacity, according to Article 102(2) (b) and 219 of the Constitution should not run.
